You should carefully read the following terms and conditions before using the software. Your use of this software indicates your acceptance of this licence agreement.

The software which is the subject of this licence is the OVERSEER^® Nutrient Budgets program.

LICENCE:

This Licence Agreement (the "Agreement") is a legal agreement between you, the end-user, and Ministry of Agriculture and Forestry, AgResearch Limited and New Zealand Fertiliser Manufacturers’ Research Association Incorporated (the “Licensor”). By using the software or storing the program on a computer hard drive (or other media), you agree to be bound by the terms of this Agreement.

This Agreement includes the copyright notice and disclaimer set out below the licence terms and is governed by the laws of New Zealand.

You may not alter the software in any way, including changing or removing any messages or windows.

You may not reproduce all or any of the software except for a backup copy of the software.

You may not sell, rent or lease the software or the software material.

You may not reverse engineer, decompile, disassemble or create derivative works from the software.

For the avoidance of doubt, you cannot use output from the software to provide inputs for another software program or commercial product without first obtaining written permission from the Licensor.

The contents of the software and the accompanying files (“Overseer”) are provided “AS IS” and without warranties of any kind either express or implied. To the fullest extent permissible and subject and pursuant to applicable law, the Licensor disclaims all warranties representations or guarantees, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non infringement, quality or performance. In addition, while the Licensor has used reasonable efforts to ensure that Overseer is free from bugs, errors or viruses, any warranty to that effect is disclaimed.

The Licensor does not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the contents of Overseer outputs, any third party information supplied, or the results of Overseer, or use of Overseer outputs (including reliance on those outputs).

By using Overseer, you agree that you are using Overseer, and its outputs, at your sole risk and that it is not a substitute for specialised advice or testing. To the fullest extent permissible by law, the Licensor is not responsible, or liable, in any way in relation to your use of Overseer or any use of Overseer outputs.

For the avoidance of doubt, this disclaimer continues to apply where data from any part of Overseer or a report produced by it are exported to other media and altered in any way.
